Welcome to our Terms and Conditions of Sale page for our travel agency and tourism services. Here you will find important information about the policies that govern the use of our tourism services and the purchase of travel packages. By booking or purchasing services with us, you agree to these terms, so we recommend that you read them carefully to understand the rights and obligations that apply to both parties. Our goal is to ensure a transparent and satisfactory travel experience; if you have any questions or queries, we are here to help.
TERMS AND CONDITIONS OF SALE
Responsibilities
Cusco Travel, a travel agency, acts solely as an intermediary for passengers. Its role is to arrange services provided by airlines, bus operators, train operators, transportation providers in general, hotels, tour operators, and/or any other independent company.
Cusco Travel has no control over these companies. Therefore, in all travel arrangements, our agency acts on behalf of our clients, organizing transportation, accommodation, and other required tourist services. Consequently, we assume no responsibility for accidents, losses, damages, delays, inconveniences, or any other irregularities that may be caused by vehicle defects, or through omissions, negligence, or carelessness on the part of any company or individual contracted by them to fulfill or carry out any service or part of the tourist service offered. This includes damages resulting from acts of vandalism, strikes, wars, government actions, weather conditions, or any other factors that may result in additional expenses due to delays, itinerary changes, or other causes.
Cusco Travel reserves the right to accept or reject any passenger reservation request for any tour or package, or to cancel or change a package if circumstances warrant. Requesting any type of service from our company will be understood as acceptance of these terms and conditions.
Prices and Rates
All prices and rates are expressed in US dollars and are subject to change without notice until payment has been received and availability has been confirmed.
Prices and rates for tour packages are per person, based on double occupancy in a standard room at all hotels, and include services, transfers, indicated excursions, specialized guides, and entrance fees (unless otherwise specified). Prices and rates do not include extras, tips, airport taxes, airfare (unless expressly stated), excess baggage, or any other travel not specified in the program.
Itinerary
Itineraries are planned with great care; however, for operational reasons, it may be necessary to change the order of activities or the specified route. While such cases may be rare, the itinerary should generally be considered only as a basic guide.
The company reserves the right to make changes to the order of excursions or trips without prior notice due to weather conditions, river levels, arrival or departure times of planes, buses, or trains, or for any other relevant reason, all of which will ensure the best possible experience for your trip.
Reservations
All reservations are subject to confirmation upon receipt of full payment for services. If a specific agreement has been reached between the company and the client, the reservation may be confirmed with a partial payment of 50% for packages with standard category hotels and 65% for packages with superior and luxury category hotels. However, the remaining balance must be paid before the start of services.
Payments for our services can only be made according to our payment methods. Once the tour package reservation is confirmed to the client via email with a confirmation code, it is guaranteed, except in cases of cancellation for reasons outlined under the heading of liabilities, which are entirely beyond the company’s control.
Hotel confirmations are subject to availability. If the selected hotel is unavailable, you will be offered another hotel of similar category and price.
Cancellations, returns, and refunds are governed by the terms and conditions stipulated in the Cancellation, Return, and Refund Policy.
Hotels (not included in a tour package)
Hotel reservations can only be confirmed upon receipt of full payment for services (unless otherwise expressly agreed). If a specific agreement has been reached between the company and the client, the reservation may be confirmed with a partial payment.
The client only needs to go to the hotel with the confirmation code and present their passport (if a foreigner) or their national identity document (if a Peruvian citizen). If breakfast or other meals are included in the hotel rate, this will be clearly specified. Guests must adhere to the established meal times according to the hotel’s policy. Any extra consumption not clearly specified as included will have to be paid for directly
Train Transportation Service (not included in a tour package)
Train ticket prices and fares are subject to availability and change without notice until they have been issued. The schedules, itineraries and timetables of these tickets are subject to change until the date of travel by the train operator.
All train ticket reservations are subject to confirmation until full payment for the tickets has been received and until they have been issued. Tickets issued for train transportation service do not allow refunds, do not allow route changes and do not allow date changes. The service operator may modify the current conditions without notice. Train operators serve their meals or snacks according to their own policies. Passengers are responsible for consuming them or not.
Any extra consumption not clearly specified as included will have to be paid directly by the passenger and it will be the sole responsibility of the passenger and the train operator for any unpaid consumption.
Payment Policy
Our payment policy, in the case of individual passengers, requires that our services be fully paid 15 days before the arrival of the passengers, unless different conditions are specified. In the case of groups, our payment policy requires that our services be fully paid 25 days before the arrival of the group together with the list of passengers, unless different conditions are specified.
Any modification to agreed services or the contracting of new services once the trip has begun will be paid directly by the passenger or may, if the agency accepts it, be charged to a credit card.
Payment Methods
Ways to make pre-payments for the confirmation of the requested services:
– VISA credit card with Verified by Visa and MASTERCARD with Securecode
– VISA, MASTERCARD, AMERICAN EXPRESS credit card through PAYPAL
– Bank deposit.
– Money transfer through Western Union or Money Gram.
Documentation
The passenger is responsible for having a valid passport or other travel document and visas according to their nationality accepted by the laws of the governments of the countries they are visiting. In order to make reservations, the following information will be required for each passenger: Full Name, Passport Number, Nationality, Age, Sex. It is recommended to inform about allergies, illnesses, passenger conditions, characteristics of each passenger, food preferences, etc.
Baggage
The weight limit accepted on domestic air flights and ground service is 20 kg. (44 lb.), free of charge. The passenger is responsible for their baggage and any claim for loss or theft must be made directly to the transport operator.
Obligations
In the event that a service cannot be provided due to an error, failure or direct fault attributable to the service operator, the latter will try to do its best to provide a solution of equal value to the service not provided. In the event that a service equivalent to the service not provided cannot be provided, the actual price of the service will be reimbursed, excluding any consequences, indirect costs or any other costs associated with the non-performance of this service. Any claim regarding any service not provided during the trip will only be accepted if it is made in writing within 7 days after the trip has ended. Regarding cancellations, refunds and money refunds, these will be governed by the terms and conditions stipulated in the Cancellation, Refund & Refund Policies.
SPECIAL CONDITIONS FOR SERVICES TO MACHU PICCHU
Contracting tourist services to Machu Picchu implies acceptance of these special conditions, which are subject to the regulations issued by the competent authorities and the commercial policies of the railway operators and other service providers involved.
1. Seat Assignment on Railway Services
Seats on train services are assigned exclusively by the railway company’s system at the time of ticket issuance and according to availability. Consequently, passenger seating is random, and the assignment of adjacent or consecutive seats is not guaranteed, even if the reservations correspond to the same purchase, group, or family.
2. Availability of Entrance Tickets to Machu Picchu
The availability of entrance tickets is limited and depends exclusively on the system managed by the competent authorities. In accordance with current regulations, approximately 150 to 200 tickets may be made available for online sale within 48 hours prior to the entry date; however, these numbers are subject to availability and do not guarantee availability. If tickets are unavailable, passengers agree that they may choose the alternatives established by the competent authority, such as purchasing tickets in person according to current procedures or rescheduling their visit for a later date with availability.
3. Coordination of Train Service Schedules and Fares
Train service schedules are limited and vary constantly depending on availability at the time of confirmation. The final issuance of train tickets depends on the final entry time to Machu Picchu; therefore, both services must be coordinated together. If, as a result of late passenger confirmation or a delay in obtaining the entrance ticket, it becomes necessary to modify the initially quoted schedules or purchase train tickets in a different fare category, the passenger will be responsible for paying the corresponding fare difference, as well as any additional costs incurred due to said modification.
4. Advance Booking Recommendation
To guarantee the availability of entrance tickets, train schedules, promotional fares, and other associated services, it is recommended that you confirm and pay for your reservation as far in advance as possible. The agency will not be responsible for lack of availability caused by late confirmations, sold-out slots, modifications mandated by the competent authorities, or changes in the commercial policies of transportation and tourism service providers.
5. Changes to Machu Picchu Tour and Entry Schedules
The tour itineraries, entry schedules, capacity limits, and other access conditions to Machu Picchu are established exclusively by the Ministry of Culture and may be modified without prior notice. In the event of changes in availability or entry conditions, the agency will adjust the itinerary to the most convenient available alternative for the passenger.
If these modifications result in changes to train schedules, transportation, or other contracted services, the passenger will be responsible for any fare differences or additional costs charged by the providers, provided these are not attributable to the agency.
CANCELLATION, REFUND & REFUND POLICY
Individual passengers and group passengers
If a cancellation request is received up to and including 60 days before the arrival date of the passengers, the refund or reimbursement will be subject to a penalty of 15% of the total cost for administrative expenses, excluding the financial expenses associated with the cost of the bank transfer, credit card commission and any other expenses and/or costs associated with the refund. Except for exceptions specified below. If a cancellation request is received up to and including 45 days prior to the passenger’s arrival date, the refund or reimbursement will be subject to a 35% cancellation fee, excluding financial costs associated with the cost of the bank transfer, credit card fee and any other fees and/or costs associated with the refund. Except for exceptions specified below. If a cancellation is received 35-20 days prior to the passenger’s arrival date, the refund or reimbursement will be subject to a 65% cancellation fee, excluding financial costs associated with the cost of the bank transfer, credit card fee and any other fees and/or costs associated with the refund. Except for exceptions specified below. No refund or reimbursement will be granted if the cancellation request is received up to or less than 19 days prior to the passenger’s arrival date. Likewise, no refund or reimbursement will be granted in the event of a no-show by the passenger(s) or cancellation during the trip. There is no refund or reimbursement for unused portions of tour packages or stays.
In the event of cancellation of tour packages that include air, bus and/or train transportation services already issued, no refund or reimbursement will be granted for these services. In the event of cancellation of air, bus and/or train transportation services already issued, no refund or reimbursement will be granted for these services.
Certain services may be interrupted or cancelled due to weather conditions, force majeure, riots, etc., or other reasons beyond the control of the hotels, airlines, suppliers or the agency itself. No refund or reimbursement will be given as a result of these interruptions or cancellations beyond our control.
Exceptions
In the case of cancellation of only the Inca Trail service, no refund will be granted for this service, given the characteristics of this service.
In the case of cancellation of tourist packages that include the train service to Machu Picchu, Sacred Valley or Puno, no refund will be granted for this service, given the characteristics of this service.

Note: Certain suppliers have more rigorous cancellation policies regarding groups. Therefore, for group reservations exceeding 10 passengers, suppliers reserve the right to impose a 35% penalty up to 90 days prior to the travel date, and 100% cancellation penalty up to 45 days prior to the travel date.
During the peak season period, our company reserves the right to alter cancellation policies if our suppliers apply penalties other than those listed above.
